PLANNING COMMISSION MEETING

 

November 4, 2010

 

MINUTES:

 

The meeting opened at 7:00 P.M.

 

Members present:  Howard Burgess, Tony Flory, Raymond Leonard, William Matteson, Andy McKane, Jerry Stearns, Tom Turner and Charlie Vajda.

 

Review of the October 7, 2010 Minutes

 

Due to a problem with the tape, it was not recorded as to who motioned to close the meeting.  It was Mr. Hoenes who made the motion and Mr. Leonard that seconded the motion and all were in favor.  This will be added to the minutes.  Mr. Leonard motioned to accept the minutes with this addition and Mr. Flory seconded the motion.  All were in favor.

 

Zoning

 

Mr. Matteson talked with Mark Blucher about trying to get money from the State for counseling fees.  Kevin Brown, the Town attorney, will send zoning regulations circa 2008.  Mr. Matteson would like the Select Board to be more involved in the process and he has also talked with Stan Rhodes and he is in agreement.  The Commission may seek advice from VLCT, Mark Blucher and Kevin Brown.  The goal is to work on a moderate zoning document.  Mr. Turner again referred to the results of the March 2010 election that showed of the 1329 voters, 1027 were in favor of some sort of zoning and 73% of those in favor wanted  more than minimal zoning.

 

Mr. Turner prepared a letter to the Select Board (attached) that included information about a DRB (Development Review Board) which is used by several surrounding towns and handles both subdivisions and zoning issues vs. a ZBA (Zoning Board of Adjustment). Mr.Turner motioned to send the letter to the Select Board and Mr. McKane seconded the motion.  All were in approval.

 

Mr. Leonard made the point that he thought very little of the previously prepared zoning document was from the Rutland Town Planning Commission and that most of it was based on State regulations and input from the Town Attorney and Mark Blucher of the Rutland Regional Planning Commission.  Mr. Matteson said that the Rutland Town Planning Commission did decide what would be included.  Mr. Zingale said that the voters can challenge the decision of the Select Board on the zoning document.

 

 

 

Green Mountain Plaza

 

Per Mr. Zingale, the Act 250 hearing on the traffic issues at the Green Mountain Plaza is in recess waiting for Mark Blucher to get with the parties involved.

 

New State Road and Bridge Regulations

 

Mr. Turner asked about the AOT document received in September regarding new State regulations for roads and bridges.  The Town did not provide input by the November 1 deadline.  Mr. Burgess said he thought that input should have been given up front before the regulations become law.  Mr. Hathaway, the Town Road Commissioner, has reviewed the document and Mr. Matteson asked if Mr. Zingale would invite him to the next Rutland Town Planning Commission meeting to discuss the topic.  It was also mentioned that the Town's subdivision regulations would have to comply with the new regulations.

 

Along these lines, Mr. Turner brought up the fact that the same numbers are not being used in referring to subdivision regulations when warnings go into the paper as what is in the Town Code book.  They refer to an old numbering scheme. Mr. Turner made the motion to ask the Select Board to adopt a numbering scheme that reflects the section numbers from the current Town Code book and Mr. McKane seconded the motion.  All were in approval.  Mr. Matteson asked that all Commission members look for their codification books as they need to be updated periodically.  Some members thought that they never received one and this could be due to retired members not turning in their books.

 

Mr. Flory made the motion to close the meeting.  Mr. Stearns seconded the motion.  All were in approval.  The meeting ended at 7:47 P.M.
