TOWN OF RUTLAND
PLANNING
COMMISSION
MINUTES
9-15-11
Commissioners Present:
Howard Burgess, Charles
Vajda, Raymond Leonard, Andrew McKane and Anthony Flory
Cold River Road residents,
Mr. Earl Miller and Ms. Judith Pritchard, appeared before the Commission
regarding clarification as to whether their proposed land transaction could be
reviewed as a lot line adjustment rather than a subdivision.
Town Administrator, Mr.
Joseph Zingale Jr., told the Commissioners that the proposal could not be
reviewed as a lot line adjustment since the parcel of land to be purchased is
greater than a tenth of an acre.
Ms. Pritchard told the
Commissioners that the land is not buildable and that she planned to let her
son park his vehicles on the parcel rather than in her yard.
Mr. Miller showed on the map
where the new subdivision line would be placed. Mr. Miller requested he not be
required to do a full survey in order to get a subdivision permit from the
Commission. Mr. McKane said a survey is required according to the Town
subdivision regulations.
Mr. Burgess questioned if
there were any monuments or pins in the area where Mr. Miller wants to
subdivide. Ms. Pritchard and Mr. Miller discussed the proposed subdivision and
what the Commission will require for information.
Mr. Burgess inquired as to
the proposed curb cut location. Ms. Pritchard described the general location.
Mr. Burgess cited the fact that a curb cut permit would be required.
Mr. McKane and Mr. Burgess
said it would acceptable to them to only survey the proposed property line.
Mr. Zingale briefed the
Commission regarding details concerning the “Service Road” kick-off meeting
with interested landowners.
Mr. Leonard moved to have
Mr. Zingale write a letter to invited landowners to the “service road” kick-off
meeting. Mr. Vajda made a second to the motion. The motion passed unanimously.
Mr. Flory moved to close the
meeting. Mr. Burgess made a second to the motion. The motion passed
unanimously.
