Planning Commission Minutes 9-15-2022
TOWN OF RUTLAND PLANNING COMMISSION
MEETING MINUTES
DATE: September 15th, 2022
LOCATION: Town Hall and a publicly accessible conference line
OPEN MEETING 6:30 P.M.
Commission Members Present: Chair Barbara Pulling, Dana Peterson, Jerry Stearns, Howard Burgess, Sherman Hunter, Andy McKane, Mary Beth Poli, and Norman Cohen. Mr. Cohen was not a voting member for this meeting.
Members of the Public Present: None
Approval of the Agenda:
Mr. Peterson moved to approve the agenda. Mr. Stearns seconded the motion. The motion passed unanimously.
New Business: Kinney Motors – Deppman Law Permit Review Request
- A letter with the same request that was discussed at the last meeting was received from a different law firm. They are also asking the Planning Commission to confirm the two properties of Kinney Motors are in compliance with all Town Ordinances.
- Mr. Peterson moved to authorize the Chair to respond that this request is not within the authority of the Planning Commission and the request is being sent to the Selectboard. Mr. McKane seconded the motion.
- After further discussion, Mr. Peterson moved to respond to the letter, copying the Selectboard, that this request is not within the authority of the Planning Commission due to the absence of zoning regulations. Mr. McKane seconded the motion. The motion passed unanimously.
New Business: Reformatted Subdivision Ordinance
- Copies of a reformatted Subdivision Ordinance were distributed.
- The draft updates the ordinance to a new consistent layout. This is also an opportunity to address spelling and grammar issues as well as add / remove language.
- Discussed whether the references to zoning should be removed. No decision was made
- Members will review the draft and forward changes to be included rather than taking up meeting time with small changes.
Old Business Update on revised Information Building ordinance
- The Selectboard was given a copy of the draft ordinance with revisions, the updated permit form and the proposed questionnaire to be included.
- Based on some comments from our Town Attorney at the Selectboard meeting, the information Building Permit form needed to be updated to include information needed from the ordinance. A copy of the new form was provided to the Commission.
- The Selectboard reviewed the documents but did not take any action. They tabled the discussion to a future meeting.
Old Business Report on Selectboard River Corridor / Flood Hazard Regulations
- The person coming to talk with the Board was not available.
- This will be rescheduled for a meeting in October
Old Business Update on Pocket Park
- The grant suggestions were given to the Selectboard.
- The Board did not take any action on this information.
Old Business Update on the Energy Survey
- We have received some responses to the survey so far.
- It is included on the banner of the Town website and was advertised on Facebook.
- An article will be included in “The Circle” when it is published in October.
- Cards with a QR code are available at Town Hall.
Announcements
- Read a letter from the Selectboard thanking the Commission for its participation in the Town Wide Celebration.
- The Cortina Inn continues to be discussed at the Board meetings. No resolution to the issues has been found yet.
- The Selectboard adopted a new version of the personnel policy. New acknowledgement pages are available for everyone. They need to be signed and returned.
Approval of Minutes August 25th, 2022:
Mr. Peterson moved to approve the minutes. Mr. McKane seconded the motion. Some clerical changes were made. Mr. Peterson moved to approve the minutes as amended. Mr. McKane seconded the motion. The motion passed unanimously. Mr. Hunter and Ms. Poli abstained from the vote.

Mr. McKane moved to adjourn. Mr. Stearns seconded the motion.
The meeting adjourned at 7:38PM.
