MEETING MINUTES

Commission Members Present: Chair Barbara Pulling, Howard Burgess, Sherman Hunter, Andy McKane, Mary Beth Poli, Jerry Stearns, Jim Hall, and Norman Cohen
Members of the Public Present: David Cleary
Public Hearing – McKinley Avenue Boundary Line Adjustment
- The public hearing was declared open.
- No members of the public were present to comment.
- The public hearing was declared closed.
Approval of the Agenda:
Mr. Burgess moved to approve the agenda. Mr. Stearns seconded the motion. There were 2 additions made to the agenda by Mr. Burgess and Mr. Stearns. The motion passed unanimously.
Old Business: McKinley Avenue Boundary Line Adjustment
- The boundary line adjustment is proposed to modify the lands of Buttrick and those of adjoining property owners.
- A new mylar was provided by Mr. Cleary. The addition of adjacent parcel property lines was added as requested.
- The submission was verified as complete.
- Mr. Burgess moved to approve the Boundary Line Adjustment. Mr. Stearns seconded the motion. The motion passed unanimously.
Old Business: Compile a list of ordinance preferences for the Selectboard
- The plan was reviewed with the Selectboard at one of their meetings. Discussed with them the possible need for legal review of any draft ordinances. The board asked for a proposal to be brought back to them with a budget request.
- Reviewed a model noise ordinance, which could address several recent issues brought up lately.
- Discussed other items, such as large animals in neighborhoods.
- Discussed a recent Vermont Supreme Court decision which may have implications in the Town of Rutland and the involvement of Act 250. The decision is expected to be appealed. This information will be shared with all Commission members.
- Discussed zoning regulations in town and how they could be beneficial.
- Discussed some of the ordinances the committee could review.
- Several Selectboard Committees have the existing ordinances on their agendas to review so the list for the commission can be limited.

- Possible ordinances to be reviewed
- Public Assembly
- Public nuisance

- Permit Tracking
Old Business: Finalize model rules of procedure
- Reviewed the change to clarify voting rights for alternate members.
- Reviewed the ability to have law enforcement remove disorderly persons from the meeting.
- Mr. McKane moved to adopt the Rules of Procedure as amended. Mr. Hunter seconded the motion. The motion passed unanimously. A clean copy will be made available at the next meeting for all members to be able to sign.
Old Business: Pocket Park Update
- The survey is done.
- Additional meetings are being planned with the Town and Green Mountain Power.
- Discussed options to be able to add additional parking, beyond the 8 spaces there currently. Several options were discussed as a broad overview. The committee plans to bring a proposal to the full board.
Announcements
Barbara Pulling and Mary Beth Poli are planning to attend the next Selectboard meeting to get a final decision on forming a Conservation Commission.
Mary Beth Poli, and others, met with the Town Recreation Committee recently to discuss improvements to Northwood Park. The grant application was not successful, and they were discussing alternative funding options.
VELCO has asked some parcels to be labeled, that were part of a recent approved sub-division application. They are planning to attend a future meeting to discuss their specific request.
Approval of minutes October 7th, 2021:
Mr. Stearns moved to approve the minutes as written. Mr. Burgess seconded the motion. After some clerical changes and clarification, Mr. Stearns moved to approve the minutes as amended. Mr. Burgess seconded the motion. The motion passed unanimously. Mr. McKane abstained.

The meeting adjourned at 8:10 PM.
