TOWN OF RUTLAND SELECTBOARD SPECIAL MEETING

- The Meeting opened at 5:30 P.M.
- Board members present Don Chioffi, Joe Denardo Mary Ashcroft, Sharon Russell, and Kurt Hathaway
- Members of the Public Present Nick Paquette, Howard Burgess, Dave Sears, Mike Rowe
Selectboard Chairman Chioffi opened the special meeting by reviewing the need for the meeting. The special meeting was called for the purpose of holding a hearing to discuss the request made by Town Resident Nick Paquette to waive the fine he was given for violating the Town Permit Notification Ordinance.
Chairman Chioffi asked Mr. Paquette to be sworn in for his testimony. Mr. Paquette agreed, and Chairman Chioffi swore him in.
Mr. Paquette said some of the violations in his notice go back more than 5 years and he has been paying taxes on them. Plans had been submitted when he would grieve his taxes. Mr. Paquette said he was told there was not permitting required at the time he initiated construction of his home.
Discussed how to handle the request to waive the fines. After some discussion, and an agreement by Mr. Paquette to not pursue any further objections to the violation, the wavier amount of $100 will be applied to this situation.
Chairman Chioffi advised Mr. Paquette that before he does any other construction on his property that he obtains a jurisdictional opinion from Act 250. A small portion of his property was included in a Mendon permit, but this does not cover the rest of his property.
Road Commissioner Sears discussed the culvert near their driveway. More water is being discharged into it since they made changes to the property. It will need to be watched to make sure it remains open.
The hearing concluded at 5:47 PM.
